Do you need an EHCP appeal solicitor, and what does it cost?

If you are facing a SEND Tribunal appeal, it is natural to search for a solicitor and brace for a large legal bill. But the SEND Tribunal was deliberately designed to be accessible without one, and the majority of parents who appeal represent themselves, not because they cannot afford a solicitor, but because the process does not require one.

What does a SEND solicitor actually cost? Rates vary, but specialist education solicitors typically charge from around £200 to £400 an hour, and a contested appeal that goes to a full hearing can run into several thousand pounds once you include drafting, correspondence, and representation at the hearing itself. Legal aid is not available for most SEND Tribunal appeals, and "no win, no fee" arrangements are uncommon in this area of law because the Tribunal generally does not award costs to either side, win or lose, so there is little for a solicitor to recover.

What a solicitor does that you may not need. A solicitor drafts your grounds of appeal, manages correspondence with the local authority's lawyers, and represents you at the hearing. But the Tribunal is inquisitorial rather than adversarial: the panel actively asks questions to understand your child's needs, rather than expecting a courtroom-style cross-examination. Parents are entitled to bring a lay representative, a supporter, or an advocate instead of a solicitor, and the Tribunal's own guidance is written for parents representing themselves.

Where the cost is usually better spent. Rather than a solicitor's hourly rate, most families get more value from an independent Educational Psychologist report or other specialist evidence, since Tribunal decisions turn on evidence about the child's needs, not legal argument. A fixed-fee EHCP consultant or SEND advocate can also help you build your case, prepare your written evidence, and structure your bundle for a fraction of solicitor rates, without the open-ended hourly billing.

When a solicitor genuinely is worth it. If the case involves disability discrimination claims, judicial review of a local authority's conduct, or unusually complex points of law, specialist legal representation can be the right call. For the great majority of appeals about the description of needs, the specificity of provision, or the school named in Section I, it is not required.
